NPK Industries does not guarantee specific crop yields, growth rates, flowering results, harvest quality, profitability, or other agricultural outcomes.
Poor crop performance, crop damage, formulation incompatibility, or customer dissatisfaction does not, by itself, establish a product defect or entitlement to compensation.
These provisions do not limit claims arising from substantiated manufacturing defects, material deviations from published product specifications, or rights protected by applicable law.
5. Product Quality and Performance Claims
NPK Industries stands behind the manufacturing quality and published specifications of its RAW Nutrients and KALIX CPN products.
Claims involving alleged product defects, contamination, or nonconformance with published specifications are subject to review and investigation.
To evaluate a claim, NPK Industries may request:
• Proof of purchase.
• Product names and lot or batch numbers.
• Photographs of products and packaging.
• Storage and handling information.
• Application rates and mixing procedures.
• Water-quality information.
• Relevant cultivation or manufacturing records.
• Representative product samples when appropriate.
Customer statements, photographs, or reports of poor performance do not automatically establish a manufacturing defect.
Where a product is confirmed to have a manufacturing defect or to materially deviate from its published specifications, NPK Industries will determine an appropriate remedy consistent with applicable law.
Nothing in these Terms excludes rights or remedies that cannot legally be waived.
6. Commercial, Wholesale, and Bulk Purchases
NPK Industries serves retail customers, commercial growers, distributors, manufacturers, and wholesale purchasers.
Commercial pricing, wholesale discounts, and special purchasing arrangements may be subject to additional eligibility requirements, approved accounts, minimum quantities, and written agreements.
Customers purchasing products for blending, repackaging, manufacturing, resale, or incorporation into proprietary formulations are responsible for verifying product suitability and compatibility before making volume purchases.
Special orders, custom formulations, and customer-specific manufacturing arrangements may be subject to additional purchasing terms and cancellation restrictions.
Where an authorized written commercial agreement establishes terms different from these Terms of Service, that agreement will govern the matters it expressly addresses.
Commercial or wholesale purchasing status does not automatically provide expanded return privileges, extended warranties, or additional remedies.
7. Pricing, Discounts, and Promotions
Product prices, availability, packaging, and purchasing conditions may change without notice.
NPK Industries reserves the right to correct pricing errors and to decline or cancel orders affected by material errors, subject to applicable law and any binding agreements.
Commercial pricing and negotiated quotations may be limited to approved customers, designated accounts, quantities, or purchasing periods.
Promotional offers and discount codes:
• Are subject to their stated eligibility requirements.
• May have restrictions on participating products or purchasing accounts.
• May be limited to a single purchase or specified number of uses.
• May exclude shipping, freight, taxes, or other charges.
• May not be combined with other discounts unless expressly permitted.
• May be withdrawn or modified prospectively, subject to applicable law and the terms of the specific promotion.
Issuing a one-time discount or goodwill accommodation does not establish an ongoing pricing entitlement or obligation to extend similar benefits in the future.
8. Orders, Billing, and Account Information

NPK Industries may review, limit, or cancel orders for legitimate business reasons, including suspected fraud, inaccurate information, regulatory restrictions, inventory shortages, or pricing errors.

Submission of an order does not guarantee acceptance or fulfillment.
For commercial accounts, payment terms, credit arrangements, and purchasing authorization requirements may be established separately in writing.
Customers are responsible for maintaining accurate and current account information.
9. Shipping, Freight, and Delivery
Shipping options, delivery estimates, freight arrangements, and related charges depend on product characteristics, destination, carrier availability, and other logistical considerations.
Delivery dates are estimates unless expressly guaranteed in writing.
NPK Industries is not responsible for delays beyond its reasonable control, subject to applicable law and any separately agreed delivery obligations.
Customers must provide complete and accurate shipping information and identify any special delivery requirements before shipment.
Additional charges caused by inaccurate addresses, inaccessible delivery locations, or customer-requested delivery modifications may be the customer's responsibility.
For freight and high-value deliveries, customers should inspect shipments upon arrival and document visible damage or shortages on the carrier's delivery receipt before signing whenever possible.
Shipping damage, shortages, and incorrect products should be reported within three calendar days of delivery, in accordance with our Refund & Return Policy.
Customers should retain original packaging and relevant shipping documentation until reported issues have been resolved.
10. Undeliverable and Refused Shipments
NPK Industries will make reasonable efforts to assist customers when shipping or delivery problems occur.
If a shipment is undeliverable because of inaccurate or incomplete information supplied by the customer, additional return freight, storage, address-correction, or reshipment charges may apply.
Customers who refuse delivery without prior coordination or authorization may be responsible for associated return freight and handling charges.
Where a refusal or delivery problem results from an error attributable to NPK Industries or documented shipping damage, we will review and address the matter appropriately, consistent with applicable law.
11. Returns, Refunds, and Cancellations
Returns, refunds, exchanges, and related claims are governed by the NPK Industries Refund & Return Policy, incorporated into these Terms by reference.
Unless otherwise required by law or agreed in writing, standard return requests must be submitted within 30 calendar days of delivery.
Approved standard returns may be subject to return shipping charges and a restocking fee, as described in the Refund & Return Policy.
Products must meet applicable eligibility conditions, including packaging, condition, storage, and return authorization requirements.
Orders may be canceled before shipment when cancellation remains operationally possible.
Custom-manufactured products, special orders, and products already shipped may be subject to additional cancellation restrictions.
